H.R.3717: Helping Families in Mental Health Crisis Act

It is a Legal Victory that Representative Tim Murphy (R-PA) introduced H.R. 3717 "Helping Families in Mental Health Crisis Act" in the U.S. House of Representatives in December 2012. The bill has 48 co-sponsors presently, 8 of whom are Democrats. Rep. Tim Murphy was a practicing psychologist before entering politics. He has served in the U.S. Congress as Pennsylvania's representative from the 18th congressional district since 2003. Rep. Rep. Murphy describes mental health system as an immoral embarrassment on the nation. Help for the mentally ill in America will soon be available if H.R.3717 is passed by the U.S. Congress. H.R.3717 provides for (1) inpatient psychiatric treatment using Medicaid insurance, (2) special training for police officers, which should reduce injuries and deaths during lunacy arrests, (3) a national awareness campaign to reduce the stigma associated with serious mental illness, and (4) implementation of assisted outpatient treatment (AOT) programs, which mandate outpatient psychiatric treatment for participants and provide subsistence assistance for food and housing. AOT programs reduce homelessness, arrests, incarceration and hospitalization by over 80% among program participants when compared to their experiences three years before entering an AOT program.

We will discuss Jerome Murdough, a homeless Marine Corps veteran who suffered from schizophrenia and bipolar disorder who was arrested in Riker's Island jail and died there of overheating in a solitary jail cell in February 2014. The National Alliance on Mental Illness says that if they get the chance, eighty percent of bipolars and sixty percent of schizophrenics could be successfully treated to fully participate in mainstream society. But such treatment and medications are not currently available to many of them, because the new "atypical anti-psychotics" and other new drugs are expensive and must be professionally administered under in-patient supervision. Inpatient treatment under Medicaid Insurance would be resumed in certain facilities under provisions of H.R.3717 "Helping Families in Mental Health Crisis Act."

March 4, 2014 - The District of Columbia City Council voted Tuesday to decriminalize possession of small amounts of marijuana in the nation's capital. Mayor Vincent Gray said he intends to sign the measure, which replaces jail time with civil fines but does not legalize the use, possession, sale or growing of pot. Congress still has veto power, though that is considered unlikely given the divided control of each chamber.

U.N. Declaration: Ratified
President Obama Ratifies U.N. Declaration on the Rights of Indigenous People

On Thursday, December 16, 2011, President Barack H. Obama provided a belated U.S. endorsement on the the United Nations Declaration on the Rights of Indigenous People. The sad irony (at least for the Indian Freedmen of the 5 Civilized Tribes with a Class Action on behalf of that class pending in the U.S. Supreme Court) is that the announcement was given before an assemblage of 320 personally invited Representatives at the White House Tribal Nations Conference at the Department of the Interior, inclusive only of "Federally Recognized Tribes", forsaking all others.

President Obama gave no particulars in his address, which he promised to address later. The United States was one of a handful of countries to refrain from backing the doctrine in the past.

The president said, "I can announce that the United States is lending its support to this declaration. The aspirations it affirms--including the respect for the institutions and rich cultures of the Native peoples--are ones we must always seek to fulfill."

Corporations Divest Nearly $60 Million From Private Prison Industry 
Scopia Capital Management, DSM North America, and Amica Mutual Insurance pulled nearly $60 million in investments from CCA and GEO Group in the final quarter of 2013, marking full divestment for DSM and Amica and a 27 percent decrease in shares for Scopia. (Scopia has decreased its private prison stock by 59 percent since December 2012.) Their announcements mark the first round of success for civil rights nonprofit Color of Change, which has been pushing over 150 companies to divest from for-profit incarceration companies since last year. Color of Change is one of 16 organizations working towards these divestment goals as part of the National Prison Divestment Campaign.

Judge Joe Brown Arrested/Released from the "Jail from Hell"


It might be a legal victory for Tennessee if Judge Joe Brown becomes Shelby County's District Attorney General. We hope to speak with Judge Brown about his candidacy since he was released from Shelby County Jail, where my brother, Larry Neal, was murdered under secret arrest in 2003. Judge Brown was arrested on contempt of court charges related to his indignation over how a juvenile court judge was running his courtroom. Fox carries the report at the link below, which includes a video and article. 


Judge Joe Brown kept talking as Juvenile Court Judge James Beasley demanded his silence. Judge Beasley started by giving Judge Brown a 24-hour sentence for contempt. Judge Brown said the juvenile court judge had no authority to sentence him for more than $10. Judge Brown said he had already checked that before the court hearing. Judge Beasley continued adding more days to the contempt sentence while Judge Brown spoke until the contempt of court sentence was five days. 

Judge Joe Brown might find that Shelby County, Tennessee observes its own code of justice that has nothing to do with what is written on paper. It is a government entity that rallies to protect offenders who are connected, including murderers in the Memphis Police Department and Shelby County Jail. This writer is almost disappointed that Judge Brown did not serve his entire sentence, which he said was illegally levied. He would have seen how much work must be done as District Attorney of Shelby County to influence the county officials and the judiciary there to respect the law.

OX News also reported Judge Brown's recent "man-up rally," which was organized to help young men realize their full potential. Judge Brown said his goal is to keep teens out of jail. Since Memphis Shelby County Jail (while under federal overview) can secretly arrest and kill African Americans without giving any accountability for the deaths, Judge Brown is potentially giving youths lifesaving advice.

New Requirements for Federal Halfway Houses

The Federal Bureau of Prisons intends to impose new requirements on the more than 200 federal halfway houses throughout the country, mandating that they provide treatment for mental health and substance abuse issues, permit cell phone use and provide transportation so that inmates can pursue jobs, Attorney General Eric Holder announced Monday. It is a legal victory for mentally ill people in federal halfway houses that they will be provided treatment for psychiatric issues and substance abuse. The federal government should levy these mandates for all halfway houses that receive any federal funds, including those where inmates are supported by social security disability checks. More halfway houses should also be opened to ensure the safety of Americans with mental disabilities and reduce the number of inmates incarcerated because of their common, treatable health disability (presently 1.25 million people). A homeless, mentally ill Marine Corps veteran was arrested for vagrancy in February, then he was literally baked to death in Riker's Island Jail. See an article about Jerome Murdough's demise:

There was a time when I thought we could negotiate a confidential settlement regarding the secret arrest and wrongful death of Larry Neal. I assumed the government and The Cochran Firm would not want it known that a mentally ill heart patient who was a U.S. citizen was killed and his survivors were defrauded by a law firm carrying Johnnie Cochran's name. We initially believed Larry's death was accidental. Not only was Larry Neal's death NOT accidental, but authorities do not seem to mind if the whole world knows that mentally and physically disabled Americans are secretly jailed and killed and that such deaths are covered up. It happens regularly. Apparently, it happened to Jerome Murdough.

Jerome Murdough was a 56-year-old mentally challenged veteran who was BAKED to death in Riker's Island in February 2014, but his family was not told for weeks. Finally, AP notified Murdough's family, not prison authorities or his attorney. The prison reportedly informed Murdough's state-appointed attorney three days after his demise. Perhaps officials and the lawyer had agreed that Murdough's family must never to be told about their relative slow-roasting to death in a Riker's Island prison cell.

Like Larry Neal, Jerome Murdough had suffered numerous previous arrests due to his mental illness before his fatal incarceration. It is likely that officials had contact information for Murdough's relatives in his file. But officials withhold information about mentally ill citizens' deaths sometimes to spare themselves bad publicity and save money on wrongful death lawsuits. That is why AIMI recommends that families physically search jails when looking for missing loved ones. Merely calling authorities and filing a missing person report are insufficient, as police lied when Larry Neal was "missing" for 18 days in 2003. He was secretly incarcerated throughout that time. Larry died in Memphis Shelby County Jail, deprived of his heart medications and likely because of other inexcusable abuses of power. The Neals were NEVER told the circumstances of Larry Neal's death, and we are censored and persecuted for asking.


If not for AP contacting Murdough's relatives, Murdough might have been "missing" forever and presumed dead. That was the likely plan. If only The Cochran Firm had not pretended (under contract) to handle Larry Neal's wrongful death and negligence civil actions, the Neals would have contacted media companies much sooner than WE DID to notify the public about Larry's secret murder. The Cochran Firm swore us to silence immediately regarding Larry's death, which we did not recognize at the time as being a coldblooded, premeditated murder. By the time we discovered The Cochran Firm had secretly withheld our lawsuits while Tennessee's statute of limitations ran, nearly a year had passed, and mainstream media had obviously agreed to withhold reports about the "wrongful death of Larry Neal" (Google it). That is still the case today. As odd as it seems, Murdough's mom and sister (pictured below) are lucky. They do not have to investigate and report Murdough's death themselves. Mother Jones reports: 

(1) The United States operate 1,800 prisons and 3,000 jails. Like Alcatraz, they aren't about rehabilitation. They're about punishment.

(2) 80,000 people are held in solitary confinement every year.

(3) As many as half of all sexual assaults in prisons are carried out by prison guards.

(4) One fourth of the people incarcerated on Earth are incarcerated in the United States.

(5) We have 2.3 million Americans behind bars . . . they’re held at ADX Florence, Pelican Bay, and Rikers Island, where an inmate recently baked to death in his cell. Baked to death.

Rikers Island is the nation’s second-largest jail system with 12,000 inmates. A whopping 40 percent are mentally ill, and a third of them suffer from serious mental problems.

Jerome Murdough was arrested after seeking shelter from harsh weather in New York in February. The meds he was administered for bipolar disorder and schizophrenia made the former Marine more susceptible to heat. One can only hope that Murdough was asleep as he slow-roasted in a solitary jail cell at Riker's.

Condolences to Murdough's family and close friends. Hundreds of thousands of people of all races and ages who were labeled as being mentally ill were roasted in Nazi ovens before WWII. Our apologies for taking so long to decriminalize mental illness in the USA and give Assistance to the Incarcerated Mentally Ill. Our messages to the public and politicians are censored. Citizen: One who by birth or naturalization owes a debt of loyalty to a country and is due protection BY that country (certain exemptions apply). Murdough showed his loyalty to the USA by enlisting in the military, but his protection as a homeless veteran was missing in action. Larry's family shows loyalty by enlisting in military service and paying taxes; however, we were told by federal court order that whatever was done to prevent lawsuit against Shelby County Jail was "immaterial." Certain exemptions apply no matter who is in the White House or over the Justice Department.

Caribbean Nations Sue for Slavery Reparations


The British human rights firm Leigh Day has been hired by the Caribbean Community consortium to pursue slavery reparations and apologies from Britain, France and the Netherlands. The suit claims that these nations are responsible for lingering harms which can be attributed to the slave trade.

    It has long been the practice to compensate people who were subjected to crimes against humanity. Consider reparations payouts illustrated on the chart below:



    European nations do not embrace the opportunity to pay reparations. The Guardian reports that David Cameron has made clear he is ready to pull the UK out of the European convention on human rights if he believes it is necessary to keep Britain safe. This assertion was supposedly issued in connection with Britain's desire to deport people who are perceived as being a threat, but the Caribbean Community's lawsuit is probably a larger impetus.
