ACLU Lawsuit re NSA Goes Forward

The American Civil Liberties Union (ACLU) filed a lawsuit against Obama Administration over National Security Agency (NSA) 'unconstitutional and un-American surveillance.'
http://youtu.be/jOqC8D8QwQ8

Overruling objections by the Obama Administration, a federal judge allowed the lawsuit to go forward. See the article at the below link
http://reason.com/blog/2013/07/09/overruling-the-obama-administration-a-fe

Congratulations to the ACLU for standing up for Americans' civil liberties. The fact that the federal judge allowed the lawsuit to proceed is a huge legal victory for The People.

Are NSA capabilities are being used to suppress news about government crimes, such as the secret arrest and murder of mentally, physically disabled people in America? See an excerpt from "NSA CONCEALS LYNCHINGS?"
http://freespeakblog.blogspot.com/2013/08/nsa-conceals-lynchings.html

Point 14. Larry Neal's murder cover-up and The Cochran Firm fraud occurred during a period when the USDOJ was already receiving negative exposure for discriminating against U.S. attorneys who were Democrats and for torture in America's offshore "War on Terror" prisons (Guantanamo and Gitmo). Therefore, there was immediate and intense resistance to my efforts to expose my mentally, physically disabled brother's murder under secret arrest and the USDOJ's complicity in the cover-up.

President John F. Kennedy denounced government secrecy, intimidation, and censorship. What would President Kennedy think of NSA secretly spying on Americans and possibly conducting a cyberwar against truth and justice?

GA Police Resolve Brunswick Baby Murder? Not Yet

Congratulations to Brunswick, Georgia law enforcement for performing gunpowder residue tests on a murdered baby's mother, Sherri West, and her boyfriend, Louis Santiago, the baby's father. Is this another "the black men did it" lie uncovered?
http://www.cbsnews.com/8301-504083_162-57594017-504083/antonio-santiago-update-gunshot-residue-found-on-slain-ga-babys-parents-report-says/

Although the couple tested positive for gunpowder residue, police had not named West or Santiago suspects in their son’s murder as of the writing of this article; however, Santiago was jailed for aggravated stalking of West. He allegedly threw furniture and accused West of killing their child. Does that mean Georgia has two innocent black boys under arrest for a murder they did not do?

De’Marquise Kareem Elkins, 17, and Dominique Demetrius Lang, 14, were arrested for murdering 13-month-old Antonio Santiago as his mother walked him in a stroller on March 21, 2013. West said the teens attempted to rob her and shot her in the leg and shot her baby in his face, killing him. Ashley Glassey, the mentally ill woman's daughter who was removed from her mother's care when she was a young child, said West asked how soon she could cash the baby's insurance policy in the same conversation when West told Ashley about her little brother's murder. Read more about the case at this article:
"The Mentally Ill as Witnesses"
http://dogjusticeformentallyill.blogspot.com/2013/03/the-mentally-ill-as-witnesses-brunswick.html

West gave numerous television interviews and accused the teens of being evil murderers for months. But the state took issue with news conferences planned by the boys' attorney, Kevin Gough. The State said that Gough is determined to try this case in the media. In April, prosecutors sought and were granted a gag order to restrict attorneys involved in this case from speaking with the media. Gough says West's willingness to talk about her baby's murder led to unprecedented media coverage and garnered 4.5 million hits on Google. He said that any statements the defense has made were meant to counter prejudicial pre-trial publicity. Troy Davis was also under a gag order in Georgia.*

It takes good police work, honest judges, credible prosecutors, ethical defense attorneys with adequate resources, and informed, unbiased jurors to Change the legal system to one in which Americans have "justice for ALL." The gunpowder residue test results should save Elkins and Lang from serving life in prison for Antonio's murder and other charges related to the baby's death. The only witness against them is West, who reportedly identified one of the teens from photos while it was she and her boyfriend who were covered with gunpowder residue. But misidentification by witnesses accounts for 75% of the nation's wrongful convictions (Buffalo News).

Forensic tests can avoid wrongful convictions and exonerate innocent inmates when evidence is available and untainted. That is why Brunswick law enforcement is congratulated for giving the parents gunpowder residue tests. It is SAD that Arkansas police did no gunpowder residue test on Chavis Carter, the black youth who supposedly committed suicide while handcuffed and locked in the back of a police car after having been searched twice. He supposedly committed suicide by shooting himself with a hidden pistol. The bullet entered Carter's right temple although he was left-handed and handcuffed. The officers who arrested Carter were not given a gunpowder residue test, either, and the police car's dash cam mysteriously stopped recording right at the time of the shooting. This writer does not expect a wrongful death lawsuit in this case, because The Cochran Firm frauds represent Carter's family. After a brief media blitz, Carter's death was ruled suicide and now seems forgotten.

For better or worse, the media plays a role in criminal justice or lack of justice. CNN interviewed Sherri West after her baby's murder when she accused the teens. However, this writer found no reports by CNN regarding the gunpowder evidence in this case. West's tearful CNN interview is at the first link in this article.

This may be another Susan Smith case.
http://en.wikipedia.org/wiki/Susan_Smith
Ashley Glassey shared her doubts about her mother's story in the interview embedded below and at YouTube link
http://youtu.be/POQhOi2y7-w . Ashley said she went to the media when police ignored her testimony.

Does it take four months to analyze gunpowder residue tests? Could it be that the justice system would prefer prosecuting two innocent blacks rather than a white woman with gunpowder residue on her hands, whose boyfriend is under arrest for throwing furniture and accusing her of the child's murder? West explained that her boyfriend went 'nuts.' West even has an explanation for the gunpowder residue, which is offered at the Fox news link below.
http://www.actionnewsjax.com/content/topstories/story/Sherry-West-says-murdered-babys-father-went-nuts/faabQKMeIkiKfAddU9x7Tg.cspx

Prosecuting the teens while ignoring evidence against the baby's parents could be volatile, especially so soon after the Zimmerman jury verdict. Hopefully, Attorney General Holder will monitor this situation to ensure justice in a racially charged trial for two impoverished black boys from a small Georgia community who continue to maintain their innocence. The trial was already removed to Marietta, Georgia in a change of venue, an area with a 33.5% African American population rather than to Atlanta, which is 60% black. One has only to browse online for "Brunswick Baby Murder" to note how the teens were immediately villainized in the press in a murder case that is essentially a matter of their word against a white mother's accusations - a mentally challenged woman who was concerned with her baby's insurance payoff from the moment the child died. West was essentially accused by both her daughter and the baby's father - people who know her best - as being Antonio's killer, but the world accuses and hurls racial insults at the teenage defendants.

The boys' murder trial begins in August. Most mainstream media affiliates and many independent news sources and bloggers carried reports about West's allegations and the boys' arrest in March, but there is a gaping scarcity of news regarding subsequent developments: the gunpowder residue found on the baby's parents' hands, West's daughter's suspicions, the father's arrest for acting erratic and accusing West of committing Antonio's murder, and West's mental illness. Reasonable doubt raised by these circumstances should lead to acquittal and release for Elkins and Lang. But in view of the shocking, racist language by Internet users against the young defendants, people who care about justice should challenge their so-called "leaders" to demonstrate some of their "justice for Martin" zeal to help these innocent boys.

Do not be surprised that the accused teens are referred to as innocents in this article. In America, everyone is presumed innocent until PROVED guilty in a court of law. At least, that is what America "said on paper" (MLK).

This is my second story out of the Brunswick, Georgia area. The first one also involved criminal allegations by a mentally ill person. Nathaniel Hickman, a black 100% disabled Vietnam veteran, alleged that his wife continually ran him over in her car. Yvonne Hickman was arrested and barred from Glynn County on Nathaniel's word, although her husband had absolutely no injuries. She said he has been hospitalized and incarcerated numerous times for chronic PTSD and drug addiction, and she was surprised at Brunswick's willingness to rely on his unsubstantiated testimony but deny her a trial timely. Eventually, criminal charges against Yvonne were dropped, but not in time to save the couple's home in a predominantly Caucasian subdivision from foreclosure. Yvonne was apparently presumed guilty from the time her husband alleged crimes that arose out of his hallucinations.

Being presumed innocent when facing criminal charges is a "right" that has little to do with reality in America's justice system, especially for Africans and people who lack wealth. Rights that are not defended and equally applied are nonexistent. This writer was told by Atlanta Police Department that I have no free speech rights in Georgia, and I discovered they were correct. I have experienced pronounced persecution and censorship for years since having the nerve to ask how and why my mentally, physically disabled brother was murdered after 18 days of secret arrest. We have been denied any records or explanation for a decade as of August 1. As blacks, we are expected to accept lynchings in stride in 21st century America, especially of "useless eaters" like Larry Neal was (Hitler's term). Persecution is particularly intense against my family at this time. I would like to advocate more for justice in this case, but out of respect for my relatives' safety which is threatened in Georgia, I will not. Hopefully, God has others in place who will make every effort to see that real justice is served.

Dr. Head v. UCLA: Gorilla Warfare

Congratulations to Dr. Christian Head, a Black surgeon and UCLA professor who won $4.5 million in a racial discrimination lawsuit against the UC Board of Regents. The complaint said that during a resident graduation event in 2006, a slide show that was created by the residents and reviewed by staff included a photo in which Head's face was superimposed onto a gorilla that was being sodomized by the Caucasian department chairman.

This writer knows how shocked and hurt Dr. Head must have been to see his own face superimposed on an gorilla, an animal that prejudice Caucasians often associate with Black people. I was similarly surprised when the "www" in a number of my Care2 links was replaced with the word "primate," and the link's users were directed to a photo of a large, black gorilla instead of to my articles the links should have reached. SOPA was a Congressional bill that provided for YOUR links to be redirected for censorship, also, but it was widely contested and was withdrawn in 2012. Censorship and persecution against Mary Neal and her family continue, however, in order to impede effectiveness as a human and civil rights advocate and suppress news about the wrongful death of Larry Neal and denial of due process of law. See "Wrongful Death of Larry Neal" online at
http://WrongfulDeathofLarryNeal.com

The $4.5 million agreement between Dr. Head and the UC Board of Regents settled the lawsuit, filed in April 2012, that accused the university of failing to prevent discrimination, harassment and retaliation against Dr. Head. The head and neck surgeon alleged that he was retaliated against for filing complaints through normal channels and was denied teaching opportunities. Dr. Head, 51, also alleged that he was routinely publicly humiliated. Without admitting fault or liability, the university acknowledged that "an inappropriate slide was shown" and regrets the incident, the university's statement said. LA Times carried the news online
http://articles.latimes.com/2012/apr/20/local/la-me-0420-ucla-lawsuit-20120420 .

The UC Board of Regents is to be congratulated for settling the matter after Dr. Head's lawsuit was filed instead of relying on censorship and terrorism which my family undergoes to prevent disclosure about my brother's wrongful death and The Cochran Firm fraud. It is extremely discouraging and seems dangerous that physicians anywhere hate Black people and perceive us as being suitable objects for their ridicule.

Many defendants in criminal matters and plaintiffs in civil actions use online services to gain support for their causes and inform the public about objectionable practices. Dr. Head posted a petition for justice online and a video about his humiliation on YouTube that received nearly 300,000 views. Ms. Shannon Foley, of Foley Lyman Law Group, spoke on the video about Dr. Head's victimization and was presumably his attorney. Congratulations to the employment lawyers! Learn more about Foley Lyman Law Group at the firm's website

Shannon Foley is a leading labor lawyer located in the Los Angeles Area in Manhattan Beach, California. She has practiced law for more than 23 years and is a “Preeminent AV Rated” Attorney as declared by Martindale-Hubbell.

Shannon represents individuals in court and in negotiations on employment law issues involving discrimination and harassment in the workplace based on sex, race, pregnancy, sexual orientation, and age as well as retaliation, wage and hour, whistleblower and wrongful termination. She also handles severance negotiations. Shannon is a member of the California State Bar, Nevada State Bar, and California Employment Law Attorneys and National Employment Law Attorneys.

Racism from unexpected sources is a fact of life for Blacks in 21st century America.

The complaint said that during a resident graduation event in 2006, a slide show that was created by the residents and reviewed by staff included a photo in which Head's face was superimposed onto a gorilla that was being sodomized by the Caucasian department chairman.

Supreme Court: NO patents on human genes

Thank you, justices!

The U.S. Supreme Court says human genes cannot be patented.

The Creator is not interested in patents and trademarks on His people, and only HE has that right.

Go sit yourself down somewhere, Myriad Genetics, Inc. The answer is NO.

ACLU agrees with the U.S. Supreme Court.

Maryland's Legal Victory: Goodbye, DP!

The State of Maryland repealed capital punishment! The ceremony during which Governor O'Malley signed the repeal was attended by Kirk Bloodsworth, a one-time Maryland death row inmate who was the first person in the United States freed by DNA evidence. The repeal does not affect the fates of five people on Maryland's death row, but the governor can commute their sentences to life without parole. Maryland is the 18th state to end capital punishment and the first state south of the Mason-Dixon line to do so.
http://www.cnn.com/2013/05/02/us/maryland-death-penalty

A day after Gov. Martin O’Malley signed a bill to repeal the death penalty in Maryland, opponents of the measure announced a petition drive to allow voters to overturn the law in 2014. The law repealing Maryland's death penalty will take effect as scheduled on October 1 after opponents failed to collect enough signatures to put the issue to a statewide vote. MDPetitions.com, the group that helped put same-sex marriage and two other issues on last year’s ballot, confirmed at a May 31, 2013 afternoon news conference that it was unable to replicate its success. Facing a midnight deadline to submit an initial batch of signatures, the group instead ended its effort.

Below is an excerpt from an article dated October 21, 2011:

How many countries have the death penalty?
Capital punishment laws are on the books in 91 countries, but only 23 of them carried out any executions last year. The U.S. executed 46 people last year, and 37 so far this year — more than any other country, except for the dictatorships of China, North Korea, Iran, and Yemen. In most parts of the modern world, the practice appears to be in steep decline. Since 1976, a total of 123 countries have effectively abolished the death penalty as a barbaric legacy of the past. All signs point to an unmistakable downward trend, says Mario Marazziti, co-founder of the World Coalition Against the Death Penalty. "There is worldwide growth of a new moral standard of decency and of respect for human rights," he said, "even the rights and lives of those who may have committed severe crimes."

Hopefully, more states south of the Mason-Dixon line will follow Maryland's lead. Southern states cling to the death penalty even though the public is turning against DP for the following reasons:
~ It targets the poor
~ It is racist
~ It kills the innocent
~ It does not deter crime
~ It is barbaric
~ It is expensive (up to an additional $90,000 per year per condemned inmate)

Message to my pro-DP brothers and sisters in Christ: You misrepresent Jesus Christ, and I certainly hope you do not want to do that. Prisoners are either saved people who have been granted God's forgiveness, or they are unsaved people who are eligible for God's forgiveness. Please listen to and share this audiotape - MaryLovesJustice Show Tape 1 "End DP in Bible Belt States" at this TalkShoe link http://www.talkshoe.com/talkshoe/web/audioPop.jsp?episodeId=621240&cmd=apop . After the first 45 minutes, there is a two-minute pause inserted by cyberstalkers, then the tape continues for another hour. I trust that you will prayerfully reconsider capital punishment. All have sinned and come short of God's glory, but "THERE IS A FOUNTAIN" http://youtu.be/IaGKfCh7OBo . Thank you.

Congratulations to Governor Martin O'Malley and the Maryland State Legislature for freeing your citizens of the financial burden and moral sin of executions.

Supreme Court: Legal Victories for Condemned Inmates

US Supreme Court orders 6 death row cases reviewed

HOUSTON -- The U.S. Supreme Court on Monday [June 3, 2013] sent the cases of six Texas death row inmates, including one of the infamous "Texas 7" gang of escapees, back to a lower court for reviews of whether attorneys in earlier stages of appeals let the men down.

The decisions are in line with last week's ruling in another Texas case where the justices, in a 5-4 vote, said a condemned prisoner had deficient legal help early because appeals lawyers didn't raise challenges that his trial lawyers were ineffective.

Read more here: http://www.miamiherald.com/2013/06/03/3430729/us-supreme-court-orders-6-death.html#storylink=cpy

It is probably a dream come true for the six condemned people to have their cases reviewed before being eligible for execution. Many defendants who must depend on overworked public defenders operating on small budgets to defend the nation's indigent people are represented by ineffective counsel. In fact, so much can happen in a criminal case to cause wrongful convictions before and during the court process that wrongful convictions are bound to happen from time to time. However, wrongful executions should never happen, and they would be impossible if every state does what Maryland recently did:

SAY DEATH TO THE DEATH PENALTY!

Supreme Court Delivers a Legal Victory re habeas corpus

Congratulations to the U.S. Supreme Court, which recently ruled in a 5 to 4 decision that a prisoner who presents credible evidence of his innocence can overcome a procedural barrier that he waited too long to go to court. See below an excerpt from my article, "How Important is Innocence in Criminal Justice?"

Unfortunately, many judges and district attorneys do not view innocence as being relevant in handing down or upholding prison sentences or even executions. Read the views expressed by Supreme Court justices in the High Court's ruling granting Troy Davis a post-conviction hearing before a Georgia federal judge on August 17, 2009. The purpose of the hearing was to determine if Davis would be granted a new trial-by-jury.
*******

“'The substantial risk of putting an innocent man to death clearly provides an adequate justification for holding an evidentiary hearing,' Justice John Paul Stevens wrote.

But Antonin Scalia, joined in the minority by Clarence Thomas, was unconvinced and unmoved.

'This Court has never held that the Constitution forbids the execution of a convicted defendant who has had a full and fair trial but is later able to convince a habeas court that he is ‘actually’ innocent. Quite to the contrary, we have repeatedly left that question unresolved, while expressing considerable doubt that any claim based on alleged ‘actual innocence’ is constitutionally cognizable.'”

Scalia’s fellow justices noted that his position allows no legal avenue for even an obviously innocent person to have his or her case heard.
*******

It is good that some Supreme Court justices have qualms about imprisoning and executing people who are "actually innocent" without a post-conviction hearing during which the inmate may present credible evidence of actual innocence.

There are judges and prosecutors across the country who feel it is perfectly acceptable to imprison and even execute innocent people as long as the accused parties had their day in court. They entirely miss the point that the judicial process is intended to discover the truth of a matter and bring justice. Justice is never served by ignoring evidence of a convicted person's innocence because it arrived late or because reversing a wrongful conviction would be inconvenient to a prosecutor's career, costly to prison profiteers, or burdensome to the court process.

The U.S. Supreme Court's ruling may help many inmates who are beyond the deadline for filing a petition for habeas corpus. "A writ of habeas corpus is used to bring a prisoner or other detainee before the court to determine if the person's imprisonment or detention is lawful. In the US system, federal courts can use the writ of habeas corpus to determine if a state's detention of a prisoner is valid. A habeas petition proceeds as a civil action against the State agent (usually a warden) who holds the defendant in custody" (Cornell Univ. Law School).

Wikipedia reports, "In 1996, following the Oklahoma City bombing, Congress passed (91–8–1 in the Senate, 293–133–7 in the House) and President Clinton signed into law the Antiterrorism and Effective Death Penalty Act of 1996 (AEDPA). The AEDPA was intended to "deter terrorism, provide justice for victims, provide for an effective death penalty, and for other purposes." The AEDPA introduced one of the few limitations on habeas corpus. For the first time, its Section 101 set a statute of limitations of one year following conviction for prisoners to seek the writ. The Act limits the power of federal judges to grant relief unless the state court's adjudication of the claim has resulted in a decision that

~Is contrary to, or has involved an unreasonable application of clearly established federal law as determined by the Supreme Court of the United States; or

~Has resulted in a decision that was based on an unreasonable determination of the facts in light of the evidence presented in the state court proceeding.

It generally, but not absolutely, barred second or successive petitions, with several exceptions. Petitioners who had already filed a federal habeas petition were required first to secure authorization from the appropriate United States Court of Appeals, to ensure that such an exception was at least facially made out."

Read about the U.S. Supreme Court delivering this legal victory to the American People at the Washington Post article, "Supreme Court Gives Inmates More Leeway to Challenge Convictions," dated May 28, 2013.
